JUDGEMENT

(1.) Heard Sri Amar Nath Yadav, learned counsel for the petitioner, Sri Ram Sagar Yadav, learned counsel for the respondent no.4 and learned Standing Counsel for the State respondents.

Present writ petition has been filed challenging the order dated 16.3.2019 passed by the Deputy Director of Consolidation, Jaunpur, whereby the revision filed by the petitioner was allowed and the order dated 29.5.2012 passed by the Consolidation Officer, Badlapur, District Jaunpur has been affirmed.

(3.) It reflects from record that by an ex parte order dated 19.6.1972, name of the petitioner was directed to be expunged from the revenue record. Against that order, petitioner filed a restoration application, which was allowed vide order dated 2.12.2004, whereby the ex parte order dated 19.6.1972 was recalled and the matter was restored to its original number. Subsequently, vide order dated 6.1.2005, objection filed by Urmila Devi was rejected and in her place name of the petitioner was directed to be recorded. A finding was recorded that name of Urmila Devi has been recorded fraudulently and the order dated 19.6.1972 appears to be an ex parte one.
