GOPAL KRISHNA KHANNA Vs. STATE OF U.P.

JUDGEMENT

(1.) The petition seeks issuance of a writ in the nature of certiorari quashing orders dated 15.01.2016 and 16.01.2016 passed by respondent no.4 (Sunil Kumar Yadav) and respondent no.1 (Principal Secretary, Department of Medical and Health, Lucknow), appended with the petition as Annexures - 1 and 2 respectively.

(2.) We have heard Shri Sanjay Kumar Srivastava, learned counsel for the petitioner; Shri Raj Baksh Singh, learned counsel for respondent no.1/State, and Shri B.K. Singh, learned counsel for respondents no.2 and 3. None has appeared for respondents no.4 and 5.

(3.) The petitioner has challenged orders dated 15.01.2016 and 16.01.2016 passed by respondents no.4 and 1 respectively with regard to initiation of process of election of six members of the Pharmacy Council. In pursuance to such initiation of process, respondent no.4 (Sunil Kumar Yadav) appointed respondent no.5 (Krishna Kumar Sachan) as Returning Officer and the schedule of election has been approved by the State Government.
