(1.) Heard learned counsel for the petitioner and Shri Dinesh Kumar Misra for the contesting respondent nos.3,4 and 5.
(2.) The writ petition arises out of an objection under Sec. 9 of the U.P. Consolidation of Holdings Act.
(3.) In this case, an issue was framed as to whether, the objection was barred by Sections 49 and 27 of the U.P. Consolidation of Holdings Act. In this regard and on a plea that this issue be decided first, the matter travelled up to this Court in Writ Petition No.41870 of 2016, which petition was filed by respondent no.5. This petition was decided vide order dated 21.09.2016. The operative portion of the judgement reads as follows -
