JUDGEMENT

(1.) Heard Sri P. V. Tripathi, learned counsel for the applicant and Sri Amit Kumar Singh, learned A.G.A. for the State.

(2.) Notice was sent to the Opposite Party No. 2/Complainant but despite service none has been appeared on his side.

(3.) The present Application under Section 482 Cr.P.C. has been filed with prayer to quash the entire criminal proceeding of Case No. 36 of 2009 (State Vs. Durga Prasad and others) arising out of Case Crime No. 339 of 2009, under Sections 363, 366, 323, 504, 506 I.P.C., P.S. Mehdawal, District Sant Kabir Nagar.
