JUDGEMENT

(1.) Mr. Shalabh Dubey, Regional Provident Fund Commissioner, Lucknow is present. He is identified by Mr. Salik Ram Yadav, Advocate who represents him, Mr. K.K. Pandey, Advocate appears for the opposite party No. 1.

(2.) Mr. Salik Ram Yadav has filed a counter affidavit on behalf of opposite party No. 2 i.e. Mr. Shalabh Dubey in compliance of the orders passed by this Court on 17.04.2019 where this Court has fixed personal appearance of the Regional Provident Fund Commissioner, Lucknow.

(3.) The Regional Provident Fund Commissioner, has explained Section 2F of the Act where in the definition clause, an employee has been defined as any person who is employed for wages in any kind of work, manual or otherwise, or in- connection with the work of the establishment, and would get his wages directly or indirectly from the employer and includes any person who is engaged on contract or through a contractor or even an apprentice engaged under the Apprenticeship Act or Standing Orders applicable to the establishment.
