JUDGEMENT

(1.) HEARD Shri R.A. Siddiqui for the petitioner and Shri V.P. Pandey holding brief of Shir B.L. Verma for opposite party No. 3. The petitioner's claim is that he had applied for engagement of Shiksha Mitra for the session 2008-09. The petitioner also claims preference in terms of Government Order dated 31.01.2008 which provides preference to a Shiksha Mitra, who by way of marriage has migrated to another village where the selection is being held. The grievance of the petitioner is that by ignoring her claim one Rishi Kapoor has been granted selection for engagement as Shiksha Mitra. According to the petitioner she would get first preference in the selection and by ignoring her claim, the authorities have acted in violation of the said Government Order. The petitioner further submits that he has approached the Basic Shiksha Adhikari concerned for redressal of his grievance by filing a representation dated 20.01.2009. It is, therefore, provided that the Basic Shiksha Adhikari concerned will consider the claim of the petitioner as well as respondent No. 5 and will decide the same in accordance with relevant and prevalent Government Order within a period of one month from the date a certified copy of this order is produced before him. With these observations, the writ petition is disposed of.
