JUDGEMENT

(1.) (Per Devi Prasad Singh and V.D. Chaturvedi,JJ.) Heard Sri Rakesh Kumar Srivastava, learned Counsel for the appellant and Sri Rajendra Jaiswal, learned Counsel for the respondents.

(2.) This is an appeal filed under Section 173 of the Motor Vehicles Act, 1988 (in short 'the Act') against the award dated 21st May, 2001, passed by Motor Accident Claims Tribunal in M.A.C.T. Case No. 123 of 2000.

(3.) Learned Counsel for the respondents has raised a preliminary objection that the present appeal is not maintainable as no permission under Section 170 of the Act was obtained from the learned Tribunal.
