(1.) Heard Shri Rahul Chahuan holding brief of Shri Yashwant Varma, learned Counsel for the petitioner, Shri Amar Nath Singh, Advocate for the Union of India, Shri Subodh Kumar and Shri Shambhu Chopra, learned Senior Standing Counsel for the Excise Department.
(2.) In this bunch of petitions, the petitioner has challenged the order dated 1-5-2009 whereby the application filed by the petitioner for provisional release of the goods has been rejected. The goods in question were seized on 22-2-2007. Thereafter proceedings were initiated and adjudication order has been passed on 30-3-2009. The authority below has held that in view of the adjudication order passed on 30-3-2009, it is not possible to entertain the application for provisional release of the goods in question.
(3.) We find no infirmity in the impugned order. The petition is devoid of substance. All the petitions are therefore, dismissed.
