JUDGEMENT

(1.) HEARD learned counsel for the petitioner and learned Standing Counsel.

(2.) THE contention advanced is that the letter which was sent by the petitioner on 4.5.2007 did not amount to a complete surrender of the rights of the petitioner to function as officiating Principal of the institution.

(3.) LEARNED counsel for the petitioner contends that in view of the aforesaid position, it was not open to the respondents to have denied the right claimed by the petitioner to continue to function inspite of the letter which has been appended as Annexure-3.
