JUDGEMENT

(1.) THIS is an appli cation by the respondent No. 4, sole private respondent praying that the Writ Petition may be allowed, the impugned orders may be set aside whereby 1/3rd share was given to respondent No. 4. THIS application is also supported by the affidavit of re spondent No. 4. In the affidavit it has been stated that as the respondent No. 4 does not belong to the same family as the petitioner and the disputed land is not the ancestral property therefore, he had no right in the same. It further mentions that the dispute has been settled between the parties out side the Court.

(2.) ACCORDINGLY, this application is allowed.
