JUDGEMENT

(1.) HEARD Shri. Indra Pal Singh, petitioner no. 2 in person as well as Shri. Gopal Mishra, learned counsel for the I.T.I. Ltd. The petitioner has approached this Court for quashing the order dated 01-08-08, annexure-29 to the writ petition and charge-sheet dated 31-03-07, annexure-27 to the writ petition. This writ petition has been filed for quashing the charge sheet issued against the petitioner. Further Shri. Gopal Mishra, learned counsel for the respondent submits that on the basis of the charge-sheet given to the petitioner, after holding inquiry an order of dismissal has been passed against the petitioner on 03- 01-09. Though, the petitioner submits that the dismissal order has not yet been served upon the petitioner but the fact remains that a copy of this dismissal order has been sent by registered post to the petitioner. The Court has perused the envelope. As the factum of receipt of the dismissal order has been denied, therefore, Shri Gopal Mishra, learned counsel for the respondent is directed to serve the dismissal order to the petitioner. As the services of the petitioner have already been dismissed, therefore, the question involved in this writ petition relating to the charge-sheet and show cause impliedly has become infructuous. Now it is open to the petitioner to challenge the order of dismissal before the competent court of law as provided under the relevant Rules. In view of the aforesaid facts the present writ petition is dismissed. No order passed as to costs.
