JUDGEMENT

(1.) Appellant has been convicted for an offence under Section 302 IPC to serve out sentence so provided in the judgment.

(2.) First bail application was rejected by this Court on 2.2.2009. It is mentioned that first bail application is rejected at this stage. Submission is that various facts and important aspects were not noted and detailed, and thus first bail application was rejected at that stage, which entitles the appellant to move bail application for detail argument on merits.

(3.) Submission is that it is a case in which there was no pre-planned and appellant was not having any deadly weapon with him.
