JUDGEMENT

(1.) COUNTER affidavit has already been filed by the State. Rejoinder affidavit against the counter affidavit filed by opposite party no.5 and the rejoinder affidavit against the counter affidavit filed by respondent no. 3 and 4 be placed on record. Sri Navneet Agarwal learned Standing counsel, as per instructions received says that so far the work of construction of spurs is concerned, they are near completion and out of 11 spurs, 2 would be completed by 30th May 2009 and 5 more would be completed by the end June 2009. The remaining construction of spurs is also under progress. Let the same be also completed by 30th June 2009. In regard to the protection of Railway lines, it has been stated that the dispute between the State Government and the Central Government has been resolved and that the Central Government has decided to include the said project in the plan, on project/plan being furnished by the State Government. The protection of the railway tracks and consequently the protection of the life and property of the inhabitants and local people is of prime importance, therefore, we do not find any reason that appropriate steps would not be taken in this regard by the State Government and the Central Government as well as by the Planning Commission. De-silting work still remains to be completed and as we are informed this has already been completed to a large extent. We expect that the same shall be completed by 15th June 2009 as informed by the Chief Engineer, Irrigation Department. As informed by Sri D.K. Upadhayay, the amount which was required for the purposes has been released by forest department. Sri Navneet Agarwal assures that the work would be completed without any delay and within possible time required for the purpose, as instructed by the Chief Engineer, Irrigation and that the entire project is being undertaken under the direct supervision of the Engineer-in-Chief. Let the matter be listed in the second week of July 2009, by which date the progress made and current status report shall be submitted by the authorities concerned before the Court.
