JUDGEMENT

(1.) HEARD learned counsel for the applicant and learned Additional Government Advocate. Gone through the FIR, bail rejection order and other documents annexed hereto. It is a case where the FIR was lodged by one Chitranjan Ram against the applicant and three others alleging therein that they have committed offence under Sections 406, 420, 467,468 and 471 IPC, police station Naka Hindola, district Lucknow on 27.11.2008 vide Case Crime No. 767 of 2008. The matter was investigated and as stated by the learned counsel for the applicant since nothing was found during the course of investigation, report under Section 169 Cr.P.C. (final report) was filed against two named accused Laxman Singh and Promod Singh and also since allegations of Sections 467, 468 and 471 IPC were not proved, charge sheet has been submitted only under Sections 406 and 420 IPC. It has been argued by the learned counsel for the applicant that the allegation levelled in the manner in which the money was extracted has not been found to be proved. It is further submitted that one of the accused, namely, Vinod Singh, against whom too charge sheet has been submitted, has been granted bail by this Court vide Criminal Misc. Case No. 368 (B) of 2009 on 22.01.2009. Taking into consideration overall aspects of the matter, particularly the applicant being lady and the investigating agency has not found allegation with respect to commission of offence under Sections 467, 468 and 471 IPC and has submitted report under Section 169 Cr.P.C against two names accused, namely, Laxman Singh and Pramod Singh, I find it a fit case for bail. Let applicant Srimati Vimla Singh, accused of Case Crime No. 767 of 2008, under Sections 406/402 IPC, police station Naka Hindola, district Lucknow be released on bail on her furnishing a personal bond and two sureties each in the like amount to the satisfaction of Court concerned.
