(1.) Heard Sri D.K. Srivastava, learned counsel for the appellant and Sri Farhat Hussain, learned counsel for the respondent.
(2.) This is an appeal filed under Sec. 173 of the M.V. Act against the judgment/order dated 18th Aug., 2006 passed by Motor-Accident Claims Tribunal, Lucknow.
(3.) The brief facts of the case are that the deceased Sadik Ali was returning to home after providing the tution on 10th June, 2002. At about 11.30 a.m. while returning home when he reached to the Kanpur Road near 32 Battalian P.A.C., the driver of the roadways bus No. U.P. 32-Z/6529 was coming with a speed and knocked the cycle. Late Sri Sadik Ali has fallen down and died on the spot. Immediately on F.I.R. was lodged at Police Station Sarojini Nagar, Lucknow. Claimants-respondents have also filed claim petition before the Motor Accident Claims Tribunal who has awarded the total compensation of Rs. 2,37,500.00. The interest was also awarded @ 7% against the U.P. State Roadways Transport Corporation. Not being satisfied the UPSRTC has knocked the door of this Honourable Court by filing the present appeal.
