JUDGEMENT

(1.) HEARD learned counsel for the applicant and learned Additional Government Advocate. Gone through the F.I.R., the bail rejection order and other documents annexed along with the bail application. It is a case where a stolen motorcycle is said to have been recovered from the possession of the applicant. It is also alleged that some forms of Regional Transport Office were also recovered from the applicant which as per the allegations were kept by the applicant for procuring forged registration certificates. It has been argued by learned counsel for the applicant that the applicant has been falsely implicated in the case since the applicant had an altercation with the police personnel. It is submitted that the applicatant was also involved in Case Crime No. 268 of 2008 under Sections 419, 420, 467, 468, 471 & 120-B IPC of police station Alambagh and it is Kargujari of the police in implicating the applicant in the present case. Learned counsel for the applicant has placed on record order dated 22.08.2008 passed by this Court in Criminal Misc. Case No. 6437 (B) of 2008 wherein on the admission of the learned Additional Government Advocate it has been mentioned that the vehicle which was alleged to be stolen one and said to have been recovered from the applicant belonged to the applicant himself and the registration certificate belonged to the same motorcycle. It is argued on this ground, the applicant was released on bail by this Court. Taking into consideration the entire facts of the case and without commenting further on the merits of the case, I find it a fit case for bail. Let applicant Arvind Kumar Yadav, involved in case crime no. 207 of 2008 under sections 379, 411, 419, 420, 467 & 471 IPC of P.S. Krishna Nagar, district Lucknow be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of learned Chief Judicial Magistrate, Lucknow.
