JUDGEMENT

(1.) THE petitioner was selected by the U.P. Higher Education Services Commission, Allahabad on the post of lecturer in Chemistry and was given a placement in Janta College, Bakewar, Etawah. Copy of the placement order has been filed by the petitioner as Annexure-1. THE petitioner's case is that when he went for joining in the college of his placement, namely, respondent no. 4 he came to know from the college that in a Writ Petition No. 1467 of 2008 the Lucknow Bench of this High Court has granted an interim order of stay and that the college could not allow the joining of the petitioner and that the college had already given intimation of this fact to the Commission. It is stated that the petitioner has filed a representation to the Director of Higher Education dated 12.2.2009 in respect of his grievance. Counsel for the petitioner states that the petitioner will file a fresh representation before the Director of Higher Education, U.P., Allahabad bringing to his notice the fact that the petitioner could not be given any joining on account of the interim order passed in the aforesaid writ petition. THE prayer of the learned counsel for the petitioner is that the petitioner may be adjusted in some other college. We have heard the learned standing counsel on behalf of the State authorities as well as the counsel for the Commission Sri V.K. Chandel. In the facts and circumstances of the case we dispose of the writ petition with the direction to the Director of Higher Education, U.P., Allahabad that should the petitioner file a representation within a period of three weeks from today regarding the aforesaid grievance the same may be considered by the Director of Higher Education expeditiously in accordance with law and he may pass appropriate orders thereon.
