JUDGEMENT

(1.) D. K. Trivedi, J. Counter-affidavit filed on behalf of the State in the bail application moved on behalf of Sultan in Case Crime Nos. 109/87 registered at P. S. Maigalganj, Distt. Kheri, under Section 3 (1) of U. P. Gangsters Act, be taken on record. Heard the learned counsel for the parties.

(2.) THE accused-applicant earlier was also challaned under Section 3 of U. P. Gangsters Act and was released on bail on 12-1-98. In the month of May, 1998, one case of firing at police party and under Sections 399/402, I. P. C. has been shown in which the accused-applicant was chal laned. THE accused applicant claims that he has been falsely implicated in this case on account of enmity.
