COMMITTEE ON MANAGEMENT, ISLAMIA INTER COLLEGE, FEROZABAD, AGRA AND OTHERS Vs. DEPUTY DIRECTOR EDUCATION AGRA REGION, AGRA AND OTHERS

JUDGEMENT

(1.) A notice of this writ petition was directed to be served on the respondent No. 3. An affidavit of service has been filed annexing the notice issued to the respondent No. 3 showing that he has been served. There is no counter - affidavit on record. The name of no counsel appears for the respondent in the cause list. We have heard the learned counsel for the petitioner and the Standing Counsel.

(2.) The two rival Committee of Management claim to have been elected as management of the institution. The Deputy Director of Education, Agra Region, Agra, by his order dated 14.4.1988 has not recognised either of the Committee of Management. He has, however, recognised the erstwhile Committee of Management for a limited duration and has directed it to conduct the elections of the Committee of Management.

(3.) The Deputy Director of Education should not have directed the Committee of Management whose term has expired, to conduct the elections.
