(1.) V. P. Mathur, J. I have heard the learned counsel. He has filed a copy of the application today that revisionist have moved for setting aside the exparte order before the Magistrate. His allegations were that the exparte order was passed on 18-3-1987 and that right up from 1-9-86 up to 30-3-87, his mother was so seriously ill, as had been rendered unable to move about and was also a heart patient and on that ground he could not attend the Court at Meerut, where the case was going on. The evidence was adduced to the case on behalf of the wife, which the learned Court below has believed to the effect that all through this period the applicant had been attending his office in Bareilly and he did not take even a single day's leave to be by the side of his mother. There is also evidence to show that his father and other brothers were also alive and living with the mother and therefore, the whole story about his absence from the Court at Meerut on the ground of his mother's illness is bogus, and has been rightly disbelieved by the Court below.
(2.) THERE is no force in this revision, which hereby stands dismissed. Revision dismissed. .
