JUDGEMENT

(1.) If the consideration of the bail application has been delayed, then it would be appropriate to set on record that the applicant himself has brought this situation. The order sheet bears out that innumerable adjournments prevented expeditious consideration of whatever relief the applicant was seeking.

(2.) The delay in the Session Court in the matter relating to the consideration of bail or the delay in the grant of it or the rejection of it are not detached and as of date the record shows that the accused and the co-accused cannot be absolved in delaying, the trial itself.

(3.) The occasion for this Court to hear the matter on bail was on 5th June, 1987. The matter was considered at length and the bail application was rejected. This Court had passed the following order:
