JUDGEMENT

(1.) Heard Shri Udai Karan Saxena, learned counsel for the appellant and Shri B.B. Paul, assisted by Shri Promod Kumar Srivastava, learned counsel for the respondent.

(2.) This is plaintiff's second appeal filed against the judgement and decree dated 2.9.1994 passed by the 1st Additional District Judge, Ghaziabad allowing the Civil Appeal No. 216 of 1982, setting aside the judgement and decree of Civil Judge, Ghaziabad passed in Original Suit No. 180 of 1981.

(3.) The plaintiff instituted the suit for specific performance of contract of sale dated 9.12.1980 allegedly executed by the defendant in favour of the plaintiff.
