JUDGEMENT

(1.) - Heard Sri Jalaj Kumar Gupta, Amicus Curiae for the appellant as well as the learned A. G. A. for the State.

(2.) The instant appeal is directed against the judgment and order dated 01.02.2012 passed by the Additional Sessions Judge, Court No.4, Unnao in Sessions Trial No.382 of 2011 (State Vs. Hari Shanker) under Sec. 304 Penal Code arising out of Case Crime No.385 of 2011, P.S. Ajgain, District-Unnao whereby the appellant Hari Shanker has been convicted for the offence under Sec. 304 Penal Code and sentenced to undergo imprisonment for 10 years and fine of Rs. 5000.00 along with default stipulation.

(3.) Being aggrieved by the aforesaid judgment and order, the instant appeal is before this Court.
