JUDGEMENT

(1.) Sri Sujaanveer Singh, Director General Prosecution, U.P. is present in person.

(2.) The difficulty noticed in the present case is with respect to the transcription of case diary by the Investigating Officers in an illegible manner. The case diaries are largely indecipherable and illegible. Once the case diary in such a form is filed in the criminal proceedings, the courts due to the very form of document placed on record face difficulty in comprehending and evaluating the truth and the proceedings are thus delayed. There is every likelihood of inconsistency creeping in when the very material collected by the Investigating Officers in their handwriting is scribbled and cramped and on asking to be made legible by the prosecution or defence, the discrepancy may become quite obvious.

(3.) The investigation is a primary duty of the investigating agency, therefore, legible and correct copies of the material collected during the course of investigation inclusive of the medical reports are bound to be filed by the investigating officers so as to project a clear picture of the prosecution case in order to maintain transparency. It is suggested by the Officer present in the Court that if a certified true typed copy of the case diary and evidences is filed at the stage of filing the charge sheet, it would serve the purpose of law. However, for implementing such a mechanism, it is informed that the Director General of Police is competent to issue necessary circulars or guidelines in this behalf.
