JUDGEMENT

(1.) Heard learned counsel for the applicant as well as learned AGA for the State of U.P and perused the material available on record.

(2.) Contention raised on behalf of the applicant has been confined to the extent that the applicant is innocent and has been falsely implicated in this case. Earlier the applicant was involved in some case concerning Section 41/102 Cr.P.C. and later on under Section 412 I.P.C. On that count, false recovery has been imputed against the applicant. Except this, there is no other criminal history of the applicant. In the case of recovery of idols, proceeding has been stayed by a division Bench of this Court vide order dated 13.09.2018 in Criminal Misc. Writ Petition No.25437 of 2018. The applicant is languishing in jail 19.07.2018.

(3.) Learned AGA has opposed prayer for bail. However, learned AGA has not disputed the aforesaid facts.
