Decided On November 13, 2018
Dev Dutta Appellant
V/S
DEPUTY DIRECTOR OF CONSOLIDATION Respondents

JUDGEMENT

(1.) Heard learned counsel for the petitioners. The instant writ petition arises out of an objection under Sec. 9A(2) of the U.P. Consolidation of Holdings Act, filed by the contesting respondents.

(2.) The contesting respondents claimed on the basis of unregistered will allegedly executed in their favour by Raghu Nath Prasad their uncle.

(3.) It appears that in mutation proceedings prior to the start of the consolidation operations, the petitioners had also been recorded as heirs of the deceased Raghu Nath Prasad, on the basis of succession, they being his nephews.
