JUDGEMENT

(1.) Heard Sri Mohd. Tabrez Eqbal, learnead Amicus Curiae for the appellant as well as learned Additional Government Advocate for the State.

(2.) The appeal is directed against the judgment and order dated 06.05.2010 passed by the Additional Sessions Judge, Court No.3, Kheri, whereby the accused-appellant Rajesh Kumar has been convicted for the offence under Sec. 376 of the Indian Penal Code and sentenced to undergo ten years rigorous imprisonment with a fine of Rs. 5,000.00 along with default stipulation.

(3.) Being aggrieved by the aforesaid judgment and order, the instant appeal is before this Court.
