JUDGEMENT

(1.) Heard learned counsel for the parties.

(2.) This civil revision is directed against the order dated 15.05.2009, whereby a counter claim, filed by the defendant respondent no.2, has been accepted by the trial Court.

(3.) The contention of counsel for the plaintiff revisionist is that the defendant respondent no.2 had been granted time on 210.2008 for filing written statement. The written statement was actually been filed on 02.12.2008. Thereafter, on 25.02.2009, issues were framed. It is, only thereafter, on 15.03.2009, that a counter claim has been lodged by the defendant-respondent no.2.
