JUDGEMENT

(1.) Heard Shri Vinod Sinha along with Shri Mahesh Sharma appearing for the defendant-petitioner and Shri Umesh Vats appearing for the plaintiff-respondents.

(2.) The vakalatnama filed by Shri Umesh Vats on behalf of plaintiff-respondents is taken on record.

(3.) The defendant-petitioner has preferred the present writ petition under Art. 227 of the Constitution of India assailing the order dated 30.05.2018 passed by Addl. District Judge, Khurja, Bulandshahar in Civil Appeal No.221 of 2016 (Om PrakashOrs. Vs. Madan LalOrs.) by which the application under Order 6, Rule 17 C.P.C. for amendment in the plaint filed by the plaintiff-respondent has been allowed on the ground that as the application under Order 41, Rule 27 C.P.C. has already been allowed, therefore, the amendment application is also liable to be allowed.
