Amit Mehrotra Appellant
V/S
Additional District Judge-24 Respondents

JUDGEMENT

(1.) Heard learned counsel for the petitioners.

(2.) Present petition has been filed for setting aside the order dated 3.8.2018 passed by revisional court in SCC Revision No. 10 of 2015. Further prayer has been made seeking direction to the revisional court to decide the amendment application paper no. 101-Ga afresh.

(3.) By the impugned order the amendment application paper no. 101-Ga for inclusion of one paragraph 22-A in the written statement has been rejected. The amendment was being sought that in the turst deed of the plaintiff-trust there is a bar for Sarvarakar to file an application for eviction of a tenant. The application was rejected by recording that the written statement was filed on 19.12.2003 and the suit was decided in the year 2014 and revision was filed in the year 2015 and after 18 years the amendment application cannot be allowed and there is no explanation for delay in seeking amendment at such a belated stage.
