JUDGEMENT

(1.) Heard learned counsel for the applicant and Sri W.H. Khan, learned Senior Counsel assisted by Sri Gulrez Khan for the opposite parties.

(2.) Before proceeding to notice the submissions advanced on this petition, it would be relevant to note the following facts. It is not disputed that the opposite party Nos. 2 and 5 have died during the pendency of these proceedings. Sri Khan, learned Senior Counsel has appeared on behalf of the opposite party Nos. 1 and 3 and has addressed submissions on their behalf. None has appeared for the opposite party No. 4.

(3.) This petition in contempt alleges disobedience of an order passed by the Court on 10 May 2017. The petition itself in which the present opposite party No. 1 was the first petitioner had laid challenge to orders passed by the authorities under the Provincial Small Causes Courts Act. After dealing with the contentions and the challenge laid to the said orders on merits the Court proceeded to dispose of the petition in the following terms:
