JUDGEMENT

(1.) Heard Sri A.C. Tiwari, learned counsel for the petitioner and Sri Kunwar Rakesh Kumar for the Union respondents as well a Sri Sanjeev Kumar Mishra, learned counsel appearing for the respondent No. 5.

(2.) This petition assails an order dated 3 February 2016 in terms of which the claim of the petitioner for appointment on compassionate grounds has been negatived.

(3.) The respondents take the position that the petitioner is the son of the second wife of the deceased Government servant and that since the second marriage was contracted without the requisite permission of the Department, no relief can be accorded to him.
