JUDGEMENT

(1.) Criminal Appeal No. 431 of 2011 has been filed against judgment and order dated 01.02.2011 of learned Sessions Judge, Lakhimpur Kheri, in Sessions Trial No. 470 of 2008: Naseem Vs. State of U.P., arising out of Case Crime No. 215 of 2006, under Section 306 IPC, P.S. Haiderabad, District Lakhimpur Kheri, by which appellant has been convicted and sentenced with four years Rigorous Imprisonment and to pay Rs.500/- as fine and in default to undergo ten days' simple imprisonment.

(2.) Criminal Appeal No. 961 of 2011 has been filed by State of U.P. against Kaishun Nisha and seven others, arising out of same judgment and order, by which respondent nos. 1 to 7 have been acquitted under Section 306 IPC.

(3.) The above two appeals being arisen from same judgment and order, are being decided together by a common judgment.
