ANWAR ALI Vs. STATE OF U.P.

JUDGEMENT

(1.) This criminal appeal has been filed by the accusedappellants Anwar Ali alias Anwar, Mahfooz alias Mahfooz Ali and Riaz Ahmad alias Riaz. The said three accused were convicted in Sessions Trial No.554 of 1998 vide judgment and order dated 03.04.2003 under Sec. 304 (II) read with Sec. 34 I.P.C. and Sec. 323 read with Sec. 34 I.P.C. For conviction under Sec. 304(II) read with Sec. 34 I.P.C., the accused-appellants have been directed to undergo rigorous imprisonment for a term of four years and under Sec. 323 read with Sec. 34 I.P.C. to undergo a sentence of three months each.

(2.) Aggrieved by the aforesaid judgment and order, the present criminal appeal has been filed.

(3.) Learned counsel for the appellants, learned A.G.A. for the State and learned counsel appearing for the complainant have been heard and record has been perused.
