JUDGEMENT

(1.) P. K. Jain, J. Heard Sri V C. Katiyar, learned counsel for the revisionist and learned AG. A for the State.

(2.) REVISIONIST, Munshi Khan, was con victed by the trial Court under Sections 7/16 of the Prevention of Food Adulteration Act and was sentenced to undergo rigorous im prisonment for six months and pay a fine of Rs. 1000/- and in default of payment of fine to further undergo rigorous imprisonment for three months. Criminal Appeal No. 88 of 1982 filed by him was dismissed by the III Addl. Sessions Judge, Farrukhabad, vide judgment and order dated 17-9- 83.

(3.) THE revision is partly allowed. Con viction of the revisionist under Sections 7/16 of the Prevention of Food Adulteration Act recorded by the Courts below is upheld. THE order of sentence is modified and the revisionist is sentenced to imprisonment for three months and pay a fine of Rs. 1000. In default of payment of fine he shall further undergo R. I. for one month. THE amount of fine may be paid within six weeks from today. THE stay order dated 12-12-83 is va cated.
