JUDGEMENT

(1.) This is a revision petition against the judgement and order dated July 26, 1996 passed by the learned Additional Commissioner, Varanasi Division, Varanasi arising out of an order dated June 13, 1996, passed by the Trial Court in a suit under Sec. 229-B of U.P. Z.A. and L.R. Act.

(2.) Briefly stated the facts of the case are that the first revision was preferred against the judgement and order, dated June 13,1996 passed by the learned Trial Court. The learned counsel for the revisionist moved an application for stay along with the memo of revision. The learned Additional Commissioner by means of his order dated July 26, 1996, has rejected the aforesaid stay application. Aggrieved by the aforesaid order the instant second revision petition has been preferred before this court. Hence, the instant second revision.

(3.) I have heard the learned counsel for the parties and perused the relevant papers on file.
