ASHOK KUMAR Vs. UDAIBHAN

JUDGEMENT

(1.) A suit under Sec. 229-B Z. A. and L. R. Act in the Court of Assistant Collector, Manjhanpur, Allahabad. The defendant raises a point that suit is barred by Sec. 49 C. H. Act. Whether to decide this as a preliminary issue. On 23-10-1996 trial Court has expressed an opinion that this shall be decided along with rest of the issues.

(2.) Aggrieved by the order defendant Udaibhan in revision. On 23-12-1996 Additional Commissioner order of dismissal. Aggrieved by this Udaibhans motion in review. It has been admitted for re-hearing; the opposite-party has been summoned. The progress of the cause in trial Court has been stopped forthwith. Aggrieved by this a revision by Ashok Kumar.
