JUDGEMENT

(1.) P. K. Jain, J. List has been revised. None appears for the revisionist. Heard A. G. A. and perused the record. Revisionist Faqirey Lal was convicted under Section 7/16 of the Prevention of Food Adulteration Act for selling adulterated rapeseed oil. He was sentenced to undergo rigorous im prisonment for six months and to pay a fine of Rs. 1000/- and in default of payment of fine to undergo further imprisonment for three months. Criminal Appeal No. 130 of 1983 preferred by him was dismissed by the 1st Additional Sessions Judge, Farrukhabad on 18-8-1983.

(2.) BY this revision the revisionist chal lenges the finding of the Courts below and conviction for the aforesaid offence on the ground that there was no sanction obtained, no compliance of provision of Section 13 (2) of ERA. Act made and the sample of rapeseed oil was taken, whereas standard for local rapeseed oil has been applied.
