JUDGEMENT

(1.) Heard Sri R.B.S. Rathaur, learned counsel for the petitioner, learned AGA for the State and perused the record.

(2.) Petition has been filed for quashing the charge-sheet pending before the learned Special Judge (Gangsters) Lucknow being Case No.384 of 2000 in Case Crime No.172 of 1999, under Section 2/3 of the U.P. Gangsters and Anti Social Activities (Prevention) Act.

(3.) Learned counsel for the petitioner submits that charge-sheet has been preferred against the petitioner on the basis of three cases being shown in the Gang Chart. One case at Crime No.5 of 1963 is shown which could not be taken into consideration.
