JUDGEMENT

(1.) (C.M. Application No.17970 of 2015)

(2.) Learned counsel for the applicants submits that the petitioners could not appear due to the miscommunication given by Shri Puneet Saxena, Advocate. Learned counsel has placed reliance upon Vishnu Agarwal vs. State of U.P., 2011 14 SCC 813 and an order of this Court passed in Criminal Miscellaneous case No.2491 of 2012.

A petition under section 482 Cr.P.C. was filed on 24.10.1998 and an interim order was passed in favour of the petitioners whereby the proceedings of case no.1005/97, pending before IVth ACJM Lucknow under section 323, 342, 504, 506 IPC, Police Station Wazirganj, Lucknow was stayed vide order dated 24.10.1998. Since then the petition was pending. It was taken up on 10.3.2015 wherein following order was passed.
