JUDGEMENT

(1.) Heard learned counsel for the petitioner.

(2.) The petitioner happens to be plaintiff in Original Suit No. 1100 of 1995 which was instituted by him for permanent prohibitory injunction in respect of property shown by letters 'Ta', 'Tha', 'Da' and 'Dha' in the plaint.

(3.) The plaint case was that the suit property was land appurtenant to the plaintiff's house and was used as a Sahan and as such it came to be vested under Sec. 9 of U.P.Z.A. & L.R. Act on abolition of Zamindari.
