(1.) Heard Mr. Ambika Prasad, learned counsel for the petitioner, as well as Mr. U. N. Mishra, learned counsel for respondents.

By means of the present writ petition filed under Article 226 of the Constitution of India the petitioner has prayed to issue a writ, order or direction considering the rules relating to service conditions of Telex and Telephone Operators posted in the High Court and direction in the nature of mandamus commanding the opposite parties not to place the Telex and Telephone Operators in the cadre of Lower Division Assistant in violation of Rule 13-A of the Allahabad High Court Officers and Staff (Conditions of Service and Conduct) Rules, 1976 and for initiating inquiry against the employees.

The brief facts giving rise to filing of the present writ petition are that the petitioner came to know in the recent meeting of the High Court Officers' Brotherhood High Court Lucknow Bench that judgment of M.P. Tandon and others vs. High Court of Judicature at Allahabad has not been complied with and the separation of posts and cadre for promotion to the post of Review Officer or the post of Section Officer had not been acted upon in accordance with rules. The promotion orders of Hari Lal Yadav-1, Haider Husain Shabi and Smt. Ratna Srivastava have also been said to be against the rules but these promotion orders have not been challenged by the petitioner in the writ petition. The gradation list, Government Order relating to Telex and Telephone Operators, working of the Registry in the High Court and separation of posts have also been alleged to be in violation of the rules and in prayer clause the petitioner has submitted it as 'Rule Ghotala'.
