(1.) Heard learned counsel for the appellant and counsel for the caveator-respondents.
(2.) This is a plaintiff's second appeal arising out of a suit for permanent injunction. The suit was dismissed by the trial Court and the judgment has been affirmed in appeal.
(3.) The first submission of counsel for the appellant is that the defendants in their oral testimony admitted the title of the plaintiff to the land in suit and, therefore, the suit could not have been dismissed.
