Facts in brief of the present case are that plaintiff/appellant had filed a suit for permanent injunction registered as Regular Suit No. 493/2004, dismissed by judgment and decree dated 30.07.2009 passed by IInd Addl. District Judge (Junior Division), Court No. 34, Lucknow. Aggrieved by the said order, he filed a Civil Appeal No. 162/2009, dismissed by judgment and decree dated 08.03.2016 passed by Addl. District Judge, Court No. 4, Lucknow. Both judgment and decrees passed by the courts below have been challenged by the plaintiff/appellant by filing the present second appeal under section 100 CPC.
