JUDGEMENT

(1.) This is a writ petition under Art. 226 of the Constitution of India challenging the order of Revisional Court dated 03.10.2016 as also the order of the Consolidation Officer dated 12.11.2010 rejecting the claim of the petitioner to title over the land in question.

(2.) The facts of the case in brief are that the land in question was recorded in the name of Janki Singh who died on 21.11.2000. As consolidation operation started, the petitioner herein, filed an objection under Sec. 9 of the U.P. Consolidation of Holdings Act, 1963 (hereinafter referred to as 'the Act, 1963') raising his claim to title over the holding of Janki Singh based on an unregistered Will said to have been executed by him in the petitioner's favour.

(3.) The sister of late Janki Singh also claimed title in terms of Sec. 172 read with Sec. 171 of the U.P. Zamindari Abolition and Land reforms Act, 1952 (hereinafter referred to as 'the Act, 1952'), as Janki Singh died issue-less.
