(1.) Heard Shri Parikshit Singh, Advocate, holding brief for Shri I. B. Singh, learned counsel for the applicant, Shri A. K. Verma, learned counsel for the opposite party No.1 and perused the record.

(2.) Criminal Miscellaneous case no.2833/2004 has been preferred to quash the proceedings of case no.86/93, U.P. Pollution Control Board vs. Elgin Mill Company Limited, pending before the Court of Special Judicial Magistrate (Pollution/CBI), Lucknow and the order dated 05.10.2004.

(3.) Petition No.176/2005 has been preferred to quash the proceedings of case no.85/1993, U.P. Pollution Control Board vs. M/s Elgin Mill Limited, Kanpur and Others pending before the Court of Judicial Magistrate (Pollution), Lucknow and the order dated 05.10.2004, whereby the application for discharge was rejected by the trial court.
