(1.) Heard Sri R.K. Ojha, learned Senior Counsel in support of the writ petition, learned Standing Counsel and Sri D.P. Singh, who has appeared for the contesting respondents.
(2.) This writ petition assails an order dated 29 November 1989 in terms of which the services of the petitioner have come to be terminated. The order further notes that retrenchment compensation in the amount of Rs. 8678.05 was being tendered along with the order of termination. In order to appreciate the issues raised in this writ petition, it would be necessary to recapitulate the facts leading up to the passing of the order impugned.
(3.) The case of the petitioner is that his father was working as the General Manager/ Secretary in the District Co-operative Bank at Ghazipur and died while in service. It is asserted that the Administrative Committee of the Bank by its resolution dated 22 April 1988 appointed the petitioner on compassionate grounds on the post of Clerk-cum-Cashier. Although a copy of the appointment letter was not available on the record, a photocopy of the same was produced during the course of hearing and with the consent of the learned counsel appearing for the Bank the same was duly perused. A reading of the same establishes that the appointment of the petitioner was for a period of six months and subject to the approval of the Board being obtained in that regard.
