JUDGEMENT

(1.) The present criminal appeal has been preferred challenging the impugned judgment and order of conviction and sentence dated 24.1.1984 passed by Special Judge, Dacoity Affected Area, Agra, in S.T. No.53 of 1982, State Vs. Kishni, P.S. Achhnera, District Agra awarding life imprisonment under section 396 IPC arising out of Case Crime No.63 of 1982, P.S. Mahuar, Achchnera, District Agra and Criminal Appeal No.305 of 1984 has been preferred on behalf of appellant Kishni and Arjun @ Bheema challenging the same impugned judgment and order of conviction and sentence dated 24.1.1984.

(2.) Since both the appeals have been preferred against the same impugned judgment and order of conviction and sentence and as such both the appeals are being considered and decided jointly by a common judgment.

(3.) During pendency of the appeal accused appellants Ghanshyam, Prem and Ram Prakash died and as such appeal in respect of them stood abated.
