JUDGEMENT

(1.) 1. Petitioners claims that they are validly appointed teaching and non-teaching staff of the Vikram Singh Vidhyalaya Junior High School Prathavipur, Mauja Khubariapur, Tehsil Chhibramau, Kannuj, District Kannauj. Petitioners submit that their appointment have duly been approved. Petitioners submit that at the point of time when institution in question is to be included in grant-in-aid list of the State Government then at that point of time without verifying the fact as to who are genuinely and validly appointed staff of the institution, the list of teaching and non-teaching staff has been sought to be manipulated. Petitioners have contended that they filed Civil Misc. Writ Petition No. 63222 of 2006 before this Court and this Court on 21.11.2006 passed following order which is being quoted below:

(2.) Petitioners are contending that till date no verification whatsoever has been done qua valid teaching and non-teaching staff of Vikram Singh Vidhyalaya Junior High School Prathavipur, Mauja Khubariapur, Tehsil Chhibramau, Kannuj, District Kannauj before sanctioning and disbursing the salary.

(3.) Once this Court has decided Civil Misc. Writ Petition No. 63222 of 2006 in terms of judgment in the case of Tilka Singh Vs. State of U.P. and others (Civil Misc. Writ Petition No. 57868 of 2005 then it is bounden duty of Director of Education, U.P. at Lucknow to take appropriate action by getting inquiry into the matter and record satisfaction individually in respect of such teaching and non-teaching staff who are entitled for salary through public exchequer. Petitioners claim that till date verification proceedings has not been done as directed by this Court on 21.11.2006 and steps are being undertaken for ensuring salary to the teaching and non-teaching staff whose name have been manipulated. As this Court has already given directives on 21.11.2006 while deciding writ petition in term of judgment rendered in the case of Tilka Singh Vs. State of U.P. and others (Civil Misc. Writ Petition No. 57868 of 2005 as such Director of Education (Basic) U.P. at Lucknow is directed to ensure that before salary is ensured to the teaching and non-teaching staff of the institution requisite verification is made as already directed by this Court. Subject to observation made above, present writ petition is disposed of.
