JUDGEMENT

(1.) PANKAJ Mithal, J. List revised. Heard Sri Lalji Sinha learned Counsel for the appellant. No one turns up for the respondent.

(2.) THIS second appeal arises from a suit for declaration. It was dismissed by the Trial Court but decreed by the lower appellate Court.

(3.) THE suit was dismissed vide judgment and order dated 18-3-1974 and it was held to be barred by time. Against the judgment and order of the trial Court the plaintiff preferred civil appeal No. 77 of 1974 which was allowed by the impugned judgment and order dated 10-11-1975 and consequentially the suit for declaration was decreed.
